These general terms of sales exclusively govern the sales of the products proposed in the website www.ballot-flurin.com. They can systematically be accessed on the website web www.ballot-flurin.com by the customer at the time of the order recording.
Consequently the order implies the consumer's adherence to these general terms to the exclusion of any other conditions found in flyers, catalogues issued by the vendor, these conditions having only indicative value.
Order: The new orders are fulfilled only if the purchaser is completely up to date with his obligations towards the vendor. Any modification or cancellation of an order required by the purchaser shall be taken into account only if the vendor received it before sending the products.
Right to retain ownership:
Notwithstanding the regulations of the clause 1583 of the French Code of Civil Law, the product property shall remain whatever the case acquired to the vendor till their total payment by the purchaser, to apply the law Nr.67-563 dated May 12th, 1980.
Delivery: Even in case of free delivery, the goods are sent at the consignee's own risk. Please check the quantities and the state of the products on delivery. For any dispute or anomaly regarding delivery, it is up to the purchaser and consignee to make precise reservations on the carrier's delivery note in the presence of the delivery man. Do not use the mark « subject to unpacking » which has no legal value. The consignee should inform the carrier with a registered letter within 48 hours after the delivery and provide the vendor with a copy of the carrier's receipt containing the reservations put forward.
The delivery charges are payable by the consignee and are subjected to a further invoicing.
Preservation: Our products are bearing expiry or use-by dates. Please see to the turnover (FIFO) and frequent renewing of your stock. Our products should be preserved in a dry area without any excessive temperature differences (optimum 15°C – except for pure Royal Jelly that has to be preserved in a cool place between 0°C et 3°C). The purchaser has an absolute deadline of eight days after delivery of the order to notify the vendor of any complaint and it is up to him to provide any proof on the report veracity.
Any product return should be done with the previous written agreement of the vendor. The return costs and risks are exclusively chargeable to the purchaser. Any return approved by the vendor should be subject of a credit note in favour of the purchaser or should be replaced by the vendor to the exclusion of any compensation or damages.
Availability: Because of the rarity of the organic products, the "wild" feature of the apiary harvests and the complexity of the organic regulations, we cannot guarantee the constant availability of the offered products. In case an order is partially or totally unfulfilled no compensation shall be granted by the vendor.
Prices: The products are sold to retail prices inclusive of tax in force at the time of the order. They can change according to the economic or fiscal situation. The customs duties or taxes for the deliveries outside France are chargeable to the purchaser.
Terms of payment:
By banker's card: Using the secure payment of the French bank Crédit Agricole via the protocol SSL (Secure Socket Layer), the provided information is encrypted to ensure its confidentiality. This payment protocol is a standard one and is agreed worldwide for the protection of the data on the Internet.

In case of late payment the vendor shall be able to stop all the orders on progress, without prejudice of any other proceedings. All the expenses caused by the collection shall be chargeable to the purchaser. All the sales made by Ballot-Flurin are liable to the French law and any dispute falls within the competence of the court of Tarbes (France) alone.
